Commercial/Fidelity Claims

  

Merchants' commercial bond portfolio includes numerous types of bonds, generally including: 

  • Fiduciary - often required for trustees, executors and administrators of estates, and conservators and guardians, to protect interested parties from failure to perform fiduciary duties
  • License & permit - required for various occupations and professions as a prerequisite to procurement of licenses and permits 
  • Court - required for participants in judicial proceedings in various circumstances
  • Public official - required for various types of government employees, to protect the public from failure to faithfully perform official duties
  • Notary - required for notaries to protect the public from financial loss due to mistake or improper conduct by a notary while performing notarial duties
  • Various miscellaneous bonds - bonds not covered by any of these categories 

Typical claimants can include any number of different individuals and entities. 

   

Merchants' Theft Guard fidelity bond program includes three coverage options-Standard, Pro, and Janitorial Services, which provide varying types/levels of protection. Fidelity bonds protect businesses and their customers from dishonest acts of employees. Typical claimants include businesses, professional service providers, and janitorial services and also their customers. 

 

Merchants' commercial underwriting team serves all 50 states and writes various types of commercial and fidelity bonds. Because requirements for a valid claim vary by state, city, bond type, and/or bond form, we are unable to provide comprehensive information regarding the procedural and substantive requirements necessary to file and perfect a claim against these bonds here. You may consider seeking legal advice with respect to your particular claim.

In your claim correspondence, please note: your name, company (if applicable), and contact information; our bond principal's name; the bond number; current claim amount (if known); your counsel (if any); and, an explanation of the issue. Please also provide any relevant documentation, including a copy of the bond and any complaint filed with a governmental agency. If your claim is against a notary bond, please also provide a copy of the notarized document at issue. If your claim is against a fidelity bond, please also provide a copy of any police report related to the act at issue.
    

Upon submission of your correspondence and receipt by our Claims Department, we will promptly assign the claim to a claims professional to begin our independent investigation of the claim. The claims professional will send correspondence to the claimant acknowledging the claim and requesting information and documentation specific to the claim and situation. He/she will also advise our bond principal of the claim and request information from the principal regarding the claim. As our investigation progresses, he/she may request additional information or documentation from the claimant and/or principal. Upon the conclusion of our investigation, he/she will advise the claimant of our response.
